Roy,

HIPAA doesn't apply in this case regarding Scout physicals. Here's why. The
form is completed and returned to the Scout (patient). Whether or not the
physician maintains a copy of that physical in the patient's chart is up to
them. However, the patient, with a copy of the physical in hand, may release
their Protected Health Information (PHI) to anyone of their choosing, including
BSA. The patient has the ultimate right in deciding to whom to release their
medical info. Now if for some unforeseen reason the physician did not provide
the Scout with a copy of the physical upon completion, and kept it in his
office medical record, then the Scout (parent actually as guardian) would have to
sign a medical release for the physician to send it to the BSA rep. Again
though, the patient always has access and rights to their own medical information
and could as easily go back to their physician and get their copy of the
physical, and then turn it over themselves to BSA.
