My immediate reaction was "no bivy's." Then my next reaction
was "how can a two person tent be a bivy." Then my final reaction
was "how is this different than other perfectly acceptable backpacking
tents like the Sierra Designs Clip Flashlight? I note this manufacturer
even makes a THREE PERSON bivy tent.
I'd say just don't mention it was advertised as something it is not,
a bivy. I did note one web page distinguished between a "bivy tent" and
a "bivy sack". Sounds like tent manufacturers trying to get some marketing
pull from the name "bivy" which is associated with ultralight.
Bottom line, I think Philmont would not have an issue with this tent.

Here is one definition of a bivy which this tent doesn't match:
Bivy
Bivys are ultralight weight water proof sleeping setup. Bivys are just
large enough for your sleeping bag. This will keep you dry for under
a 12 ounces (though most are closer to 20 ounces).
Bivys are designed for one person and most do not include room for
your gear. Bivys are not appropriate if you are claustrophobic.
