        you would certainly be well served to post this on the Scouts-L
list-server, where this topic is endlessly discussed.
 
        To paraphrase the Supreme Court Justice's famous line, "I can't define
it but I know it when I see it." "Scout Spirit", "Leadership", and
"Active" are the three *subjective* criteria needed to advance. It is
possible to convert the subjective Activity and Leadership requirements
into formalized objective criteria, e.g., must make a certain percentage
of meetings and activities per quarter, must teach a certain number of
advancement sessions, must act as a Patrol leader for "X" meetings
and/or "Y" activities, etc. But that it quite difficult to do with
Scout Spirit.
 
        One of things I do in my Scoutmaster Conferences is ask the Scouts how
they define Scout Spirit and then grade themselves on it. Some of the
answers include: Active volunteerism (especially doing the thankless
and/or unrecognized jobs without being asked or prodded), coming to
meetings ON TIME and in FULL UNIFORM (and not blowing out the door
early), teaching advancement both well and with motivation,
enthusiastically pushing signups for upcoming activities (and going
yourself), learning the younger Scouts' names and treating them well
(and if necessary protecting them), helping the younger Scouts on
activities (especially campouts, especially novices), and being a
positive behavioral role model. There's more, but you get the drift.
The Scouts who do all this are the guys who are the guts of your Troop -
the others are just resume enhancing imposters and a boat anchor around
your neck.
 
Don't argue with a lawyer; you'll never win. ASK YOUR SCOUTS - they
will give you the truth, even the ones who have lousy Scout Spirit. And
remember, the best way to increase Scout Spirit is to have an exciting
and vibrant program (including, of course, Philmont and other high
adventures). If you do that, I suspect you'll find the question becomes
moot for most of your Scouts.
