I don't think it would be an administrative thing as much as a forewarning
issue. It might be an insurance issue.
California allows a parent to sign away a minor's right to sue, Nevada does
not? California supports releases, Nevada is a lot tougher. Insurance
coverage may be different once a state line is passed? Maybe the insurance
company underwriter thinks it would be a good thing for some reason. The
underwriter had a bad experience in Nevada. Maybe there is a Nevada issue
with automobile insurance coverage.
Maybe it is a SAR thing. I know our local SAR hates it when out of state BSA
units are in their region, which is all the time. Maybe Nevada SAR
requested the council to do it.
I see the issue as a slight pain in the butt. The forms takes a few minutes
to do the second time, first time is a pain. But after that it is not that
hard to let someone know where you are going. Collecting a copy of every
parents driver's license and putting them in a file takes a lot of the pain
out of the situation.
I don't understand why National and even less so why some councils deal with
their liability issues they way they do. But tour permits I do know are
becoming more of an important issue. However, I believe they create
liability to some extent, but they have existed for decades so BSA can't get
rid of them. Now they tour permits are around, they better be collected and
used. (By collecting a tour permit the council is exercising control over an
organization that they do not have control over so it is another link in
bringing the council into the lawsuit. However I've seen the failure to
collect tour permits now being held against the council since they are
collected.)

Okay, Jim, lawyer to lawyer, what effect would occur from an internal
administrative form that would relate to changes of jurisdiction?
I sure can't think of any. About the only thing the local tour permit
relates to is whether you have insurance coverage and that
is entirely up to the local council and its carrier (unless self insured).
Put another way, what legal issues would change if you did or did not have a
local tour permit in a different state?
